What Kind of Compensation Do I Deserve After an East Boston, Massachusetts Car Accident?
If you were injured in a car accident, you have the legal right to seek compensation for all your losses and expenses.
Massachusetts is a no-fault car accident state, but people hurt in East Boston car accidents can still pursue compensation and damages from at-fault drivers (the drivers responsible for causing the car accident). People can also file a claim with their insurance policies to seek compensation and damages.
PIP: What Will and Will Not Be Covered By Your Personal Injury Protection After an East Boston, MA Car Accident
All drivers in Massachusetts must have at least $8,000 in Personal Injury Protection (PIP) coverage per person per accident. Because Massachusetts is a no-fault state, PIP will pay up to $8,000 regardless of who caused the accident. If you can’t work after the accident, PIP will pay your medical bills and lost wages up to this cap.
PIP coverage applies to you, anyone you let drive your car, anyone who lives in your house, passengers in your vehicle, and pedestrians. If you are hurt in an East Boston car accident, PIP will cover up to $8,000 of medical costs in addition to your deductible. If you can’t work due to your injuries, PIP will also cover up to 75% of your lost wages, but still only up to the $8,000 PIP maximum.
We highly recommend all Massachusetts drivers have Uninsured and Underinsured Motorist (UM) insurance coverage on their car insurance policies. UM coverage provides compensation well above and beyond your $8,000 PIP maximum. UM provides coverage even if the other driver who caused the accident leaves the scene (such as in a hit-and-run) or if they don’t have enough insurance coverage to pay for all your losses (such as medical bills and lost time from work). UM’s benefits enormously outweigh the slight price increase in your insurance premium.
In addition to PIP having an $8,000 limit, PIP does not cover all types of losses. For example, PIP will not compensate you for the pain and suffering you experience. An attorney, however, can work for you to receive compensation for your pain and suffering.
What Are My Options If Someone Else Caused the Car Accident?
Never assume you are at fault for a car accident in Massachusetts. As long as you were 50% or less responsible for the East Boston crash, the other driver is considered “at fault” for the accident. If you were hurt in an accident, even if you were partially responsible (i.e., partially at fault) for the crash, you might still be entitled to compensation from the other driver.
What Compensation Does an At-Fault Driver in East Boston Owe Me After An Accident?
If another driver caused the car crash, you are entitled to compensation above and beyond your PIP benefits for your medical bills and time lost from work. You can recover the full scope of your losses through a liability claim against the other driver.
What Losses Can I Recover in a Liability Claim Against Another Driver?
- Medical bills
- Disfigurement and scarring
- Property damage
- Pain and suffering
- Lost wages (loss of income and loss of future income)
- Other accident-related losses and expenses
You also have legal rights if you lost a loved one in an East Boston car accident. Spada Law Group can file a wrongful death case on your behalf, which allows you to seek recovery for the medical care and other damages suffered by your loved one.

Can’t I Just Settle My East Boston Car Crash Case on My Own?
Technically, yes. But it’s not a good decision. Sometimes, the at-fault driver’s insurance company will contact an injured person after a car accident and offer a monetary settlement. Sometimes even the injured person’s insurance will also offer a monetary settlement. If you accept this settlement or otherwise file your own claim after an East Boston car accident, you leave money you have a legal right to on the table. If an insurance company is willing to settle with you, it is a good indication that it knows it is saving money if you agree to a settlement – which means you deserve more.
A Massachusetts car accident attorney knows all of your rights after an injury in a crash, and we know how to protect and fight for your right to the maximum settlement or trial verdict possible. If you do not hire an injury lawyer, the insurance companies will likely use tricks and other tactics to lower the value of your injury case. Without an attorney, your settlement will be less than what you deserve.
How Can I Protect My Rights After an East Boston, MA Car Accident?
You can do several things to protect your rights after being injured in an East Boston car accident.
What not to do:
- Do not admit guilt. This includes NOT saying “sorry.”
- Do not talk to the other driver’s insurance company.
- Do not give a recorded statement.
- Do not sign anything.
- Do not accept any compensation.
- Do not provide any documents to the insurance companies.
- Do not release any medical records or other records.
- Do not post about your case on social media.
Can I Talk to Insurance Companies After My Car Accident?
You can only talk to insurance companies about very limited things after being hurt in a car accident.
If it is your own insurance company: We recommend only speaking about one thing. You may talk freely about damages to your car. If the insurance company asks about how the accident happened or your injuries, ONLY answer their questions if you already spoke with a car accident lawyer. When the insurance company asks, simply say, “I’m not answering those questions until I’ve talked with my attorney.” If the insurance company requests a statement or an examination under oath, you MUST get an attorney beforehand.
If the at-fault driver’s insurance company wants to talk to you: Refuse to talk to the company without an attorney. Always talk to a car accident attorney before speaking to the at-fault driver’s insurance company. You can say something as simple as “I’m not discussing anything about the accident without my attorney present.” If they request a statement, you MUST get an attorney before providing a statement to ensure your rights are protected.
How Long Do I Have to File a Car Accident Case in East Boston, Massachusetts?
Most of the time, you have three years from the date of your car accident in East Boston to file a claim. This generally means your attorney has three years to either reach a settlement in your case or file a court claim to go to trial.
If you do not reach a settlement or file a lawsuit within three years, you lose your right to pursue compensation for your injuries and damages from the person who caused the car accident. This three-year period is the statute of limitations for injury cases in Massachusetts.
The sooner you hire an attorney, the better, as it will provide more time for the attorney to negotiate with insurance companies and at-fault parties. If, for example, you don’t contact an attorney until 2.5 years after your accident, your case will be weaker, and the attorney has less time to negotiate a settlement before you need to decide whether to pursue a trial.
If My Car Accident Was Minor, Is It Worth Hiring an Attorney?
We always recommend having a free consultation with a car accident attorney after your injury. An attorney can tell you whether your case is actually “minor” or not. People often don’t realize how significant their accident is from a legal standpoint. Meeting with a professional means you have much to gain and nothing to lose.
Too often, a person injured in a car accident believes their case is “minor.” But in our free consultation, our attorneys can show them how they are entitled to compensation far above and beyond their PIP coverage.
Every East Boston car accident is unique. A local car accident lawyer will consider the severity of your injuries and other losses and expenses to evaluate your claim. These factors, and many others, such as who caused the accident, affect the value of your lawsuit settlement or verdict. Our legal team will consult with experts and gather evidence to determine the fair value of your car accident and injury claim.
A thorough investigation will reveal all the damages you’re entitled to compensation for, including losses, expenses, and non-economic losses (pain, suffering, trauma, and more).
