An elderly man who was legally blind was walking on a public sidewalk in Boston. An adjacent restaurant used a bulkhead in the public sidewalk to accept deliveries.

On the date in question, the restaurant left the bulkhead doors open with inadequate guarding or supervision.  As our client navigated the sidewalk with the help of a sight stick, he caught his foot on the edge of the open hole and fell 8 feet headfirst into the basement of the restaurant.

He suffered massive head injuries and died several weeks later at the hospital.  Remedial measures were subsequently implemented as a result of our lawsuit which will hopefully prevent such a tragedy from occurring in the future. Case settled for the full amount of the available insurance coverage.
