Our client was riding to work on his 2000 Suzuki motorcycle. He was traveling south on a main road. This section of road consists of 4 lanes, 2 heading south and 2 heading north divided by double solid yellow lines.
Traffic on this morning was heavy and the weather was clear and dry. Our client was traveling in the right lane when he heard the vehicle traveling to his left and slightly in front of him jam on its’ brakes.
Instinctively our client began to apply his brakes and simultaneously noticed that a UPS Delivery Truck, who was traveling in the opposite direction, had crossed the double solid yellow lines and proceed to take a left-hand turn directly across oncoming traffic and into our client’s path. Our client, in an attempt not to go under the box truck and possibly avoid contact, swerved to his left.
Unfortunately, our client was unable to avoid smashing into the rear passenger side of the truck, tearing open his right knee in the process. This case was heavily litigated for over 18 months.
