Our client, a police officer, was called to break up a disturbance at a vacant city lot on a summer evening. The lot had been undeveloped and vacant for many years and was littered with construction debris and trash. The topography of the land was hilly and uneven due to years of the owner using it as a dumping ground for his unused landfill.
Due to the dark and unsafe condition of the land our client fell off a mound of dirt during his call and seriously injured his back. The case was tried to a conclusion as the owner did not want to settle.
