Truck Accidents

HERNIATED DISC IN NECK / SETTLEMENT $300,000

Our client was traveling down a road approaching a sharp right hand curve at the same time a tractor trailer was traveling on the same road in the opposite direction. As the tractor trailer turned left at the curve, the trailer portion of the rig was brought into our clients travel lane causing a collision. Our client was a 19yr old woman who was a passenger in a Honda Civic. The vehicle she was in was struck from behind by a tow truck traveling at a high rate of speed. The rear seat passenger of the car she was in unfortunately died in the fiery wreck which our client had to witness. Our client’s physical injuries healed rather quickly but she was left with significant emotional issues.

Our client was struck from behind by an 18 wheeler. The impact caused him to hit his head on the headrest of his car. Our client began to experience hearing loss in his right ear. In one of our most difficult but rewarding cases, we assisted a client who rear ended a delivery truck on Route 2 in Lexington. Almost always, the person who hits another vehicle from behind is the at fault party. In this case through diligent investigation during the litigation process, we were able to prove that the truck driver was late for his next delivery and was lost. We proved that upon realizing he was traveling in the wrong direction (and not wishing to travel several more miles in the wrong direction) he abruptly applied his brakes in order to take an illegal U turn. Our client had insufficient time to avoid the truck or take evasive action and slammed into the rear of the truck. To say the case was hotly contested would be an understatement.

Motorcycle Accidents

Our client was a passenger on a moped operated by her adult son. When her son attempted to turn left they were struck by a car traveling in the opposite direction. Our client sustained a massive right leg injury requiring her to be airlifted to Boston for emergency surgery. Our client was riding to work on his 2000 Suzuki motorcycle. He was traveling south on a main road. This section of road consists of 4 lanes, 2 heading south and 2 heading north divided by double solid yellow lines. Traffic on this morning was heavy and the weather was clear and dry. Our client was travelling in the right lane when he heard the vehicle traveling to his left and slightly in front of him jam on its’ brakes. Instinctively our client began to apply his brakes and simultaneously noticed that a UPS Delivery Truck, who was travelling in the opposite direction, had crossed the double solid yellow lines and proceed to take a left hand turn directly across oncoming traffic and into our client’s path. Our client, in an attempt not to go under the box truck and possibly avoid contact, swerved to his left. Unfortunately, our client was unable to avoid smashing into the rear passenger side of the truck, tearing open his right knee in the process. This case was heavily litigated for over 18 months.

RIB FRACTURES, ROTATOR CUFF TEAR / SETTLEMENT $125,000

Our client was taking an exit off of Route 128 South and merging onto Route 114 West. As he merged onto a dedicated lane on Route 114 West he was forced off the travel part of the road by a car also traveling westbound.

Slip & falls and other injuries on residential and commercial premises

DEATH / SETTLEMENT $1,000,000

An elderly man who was legally blind was walking on a public sidewalk in Boston. An adjacent restaurant used a bulkhead in the public sidewalk to accept deliveries. On the date in question, the restaurant left the bulkhead doors open with inadequate guarding or supervision. As our client navigated the sidewalk with the help of a sight stick, he caught his foot on the edge of the open hole and fell 8 feet headfirst into the basement of the restaurant. He suffered massive head injuries and died several weeks later at the hospital. Remedial measures were subsequently implemented as a result of our lawsuit which will hopefully prevent such a tragedy from occurring in the future. FRACTURED ANKLE / SETTLEMENT $80,000

Our client was entering the front door of a popular retail store in Saugus MA when she slipped and fell on a wet floor that was negligently allowed to remain within the front entrance of the premises. As a result of the fall, our client severely fractured her left ankle.

BURNS ON TODDLERS FEET / SETTLEMENT $90,000

Our client was a toddler who was visiting Boston with her parents during the summer months. The child was walking barefoot without incident in the Faneuil Hall Market Place when she stepped on a manhole cover. The cover was extremely overheated due to a steam malfunction below ground. The child’s feet were severely burned as a result and she required medical attention. She made a full recovery. We discovered that the private company charged to provide steam to local businesses did not properly maintain their equipment which caused the malfunction and subsequent overheating of the manhole cover. Remedial measures were subsequently implemented as a result of our lawsuit which will hopefully prevent such a tragedy from occurring in the future.

FRACTURED SHOULDER / SETTLEMENT $125,000

Our client was walking through a commercial parking lot on a late November morning when he slipped and fell on black ice, severely fracturing his shoulder. The reason there was black ice was because the landowner failed to shut the landscaping sprinklers off prior to temperatures dropping below freezing. This case was contested by the landowner and required 2 years of litigation to resolve.

2ND DEGREE BURNS ON ARM / SETTLEMENT $150,000

Our client was seriously injured while attending a house party. Our client was severely injured when a guest at the party threw a spray paint can into a large open fire the homeowner had permitted to be lit on his property. The spray paint can exploded sending a fireball of flames and molten paint at our client. Our basis for liability in this case was that the homeowner was present while an alcohol and drug fueled party raged on in their backyard. They permitted a large open fire to be burning right in the middle of the party where they knew alcohol was being consumed. Numerous city ordinances and local laws were violated that evening by the homeowner.

ANKLE FRACTURE / SETTLEMENT $150,000

Our client was a tenant in a triple decker. She fell down a flight of stairs and fractured her ankle. The stairway in question was required to have handrails pursuant to The Massachusetts Sanitary Code. As such it was our position that by violating the Sanitary Code, the landlord ran afoul of the Implied Warranty of Habitability which protects all Massachusetts tenants. Under this scenario it was likely that the landlord would have been held strictly liable to our client for her injuries.

SERIOUS BACK INJURY / AMOUNT OF AWARD $80,000

Our client, a police officer, was called to break up a disturbance at a vacant city lot on a summer evening. The lot had been undeveloped and vacant for many years and was littered with construction debris and trash. The topography of the land was hilly and uneven due to years of the owner using it as a dumping ground for his unused landfill. Due to the dark and unsafe condition of the land our client fell off a mound of dirt during his call and seriously injured his back. The case was tried to a conclusion as the owner did not want to settle.

SERIOUS FOOT BURN / SETTLEMENT $250,000

Our client was a commercial kitchen cleaner. His job was to clean the stainless steel hoods in various restaurants in Boston during the overnight hours. During one such night, he slipped while cleaning a hood causing his foot to be submerged in scalding vegetable oil in the fryolator. He suffered 3rd degree burns requiring skin grafting. The case was litigated and liability was vigorously contested. Our theory of liability was that due to his inexperience in the business, he should have been made aware that the area under where he was standing was in fact an oil reservoir. Also, the area was not properly covered as the covers being used did not fit. Lastly, the fryolator was never turned off as required by management prior to the cleaners beginning their evening work.
